Amendments to the Customs Code of the Russian Federation adopted by the State Duma in first reading
Deputy Nadezhda Azarova, co-author of the document and reporter on the bill, noted that the amendments were necessitated by a legislative backing for collecting customs duties beginning in 2005. The present wording of the Russian Customs Code, effective since last January 1, lacks a clear-cut notion of customs duties, list of their kinds, procedure for setting rates, calculation of amounts to be paid in customs clearance, accompanying and storing of goods moved across the Russian customs border. The bill provides the definition of customs duties and fixes a limited list of the kinds of customs duties - for customs clearance, accompanying and keeping. It sets the list of payers of customs duties, when and how they shall to be paid. The setting of fixed rates for certain duties in the body of the bill makes it law in force. As noted in the explanatory documents to the bill, its adoption closes the legal gap as regards customs duties starting in 2005 and will promote Russia's joining the World Trade Organisation. Duma deputies also adopted in first reading amendments to the federal law On the Customs Tariff. The law describes methods for establishing the customs value of goods brought into the customs territory of the Russian Federation. Also, it dovetails Russian legislation into the international covenant - the General Agreement on Tariffs and Trade, which regulates the procedure for establishing the customs value of goods brought into Russia's customs territory.
