A Moscow court Wednesday postponed until April 6 hearings in an appeal lodged by lawyers for Mikhail Khodorkovsky. The Zamoskvoretsky district court was scheduled to hold appeal hearings against the jailed Yukos owner's transfer to a penal colony in the Chita Region in East Siberia, but the Federal Penitentiary Service again failed to present data on the availability of prison cells in penal colonies as of October 1, 2005, Khodorkovsky's lawyer Yury Shmidt said. Although the service said the data was for internal use only, the defense team argued that it was not a state secret and should be made available to court officials. The former Yukos CEO was transferred to a penal colony in the town of Krasnokamensk in the Chita Region, about 3,000 miles east of Moscow, on October 15, 2005, and is serving an eight-year prison term for tax evasion and fraud. Khodorkovsky's defense says that prisoners may not be sent to penitentiaries outside their home regions.
